Reducing the Tax Impact on the Sale of Your Business
Article  |  Business Owners

Your Questions Answered

A family trust is an arrangement that allows a trustee to hold and manage assets for the benefit of the trust creator’s family members, referred to as the designated beneficiaries. It is a powerful estate planning tool, which helps to transfer assets across generations, and potentially protects assets from creditors and legal claims.

A trust is a legal entity that holds and manages assets for beneficiaries according to specific terms outlined by a grantor, whereas an estate is managed through probate and comprises all liabilities a person leaves behind at death and all assets distributed according to their last will and testament.

A dynasty trust is designed to transfer wealth across multiple generations without incurring estate, gift, or generation skipping transfer taxes at each generational level. In this arrangement, a trustee has discretion over when beneficiaries receive distributions, which aids in preserving family assets and may provide asset protection.
